Some of the providers have seen the "Private Forum" discussion in the providers group. After making contact with several other members on the Flickr PFRE group, we've concluded that work should continue on a dedicated Pro forum. After throwing up a quick forum using Ning, it came to my attention that Ning has changed the TOS to include the following:
"You hereby grant Ning, during the course of your usage of the Ning Platform, a nonexclusive, worldwide, royalty-free, perpetual, irrevocable, sublicenseable and transferable right and license to (i) use, reproduce, create derivative works of, distribute, publicly perform and publicly display Your Content (a)"

They go on to say that it's only for displaying on the Ning platform but they also add:
"In addition to the rights, licenses and privileges referred to above, you agree that Ning, in its sole discretion, may use and refer to your trademarks, service marks, trade names, image, character, logos, domain names and other distinctive brand features or identification in marketing materials, financial reports, presentations, website materials, customer lists and other media now known or hereafter discovered in connection with the marketing, advertising and promotion of the Ning Platform, and any products, goods, features, capabilities and/or services associated with the Ning Platform."

So, the only thing I ask is does this worry anyone?

Work on a new forum will continue but we may do it outside of Ning now. There will no doubt be several members alarmed by Ning's rights grab, although somewhat limited, and will resist posting there. A private forum and photo pool should help to combat image theft by the foreign blogs that is prevalent with Flickr, but we still need to be able to display them legally. If I have to use a platform in which I can set the TOS, I only plan to include something similar to:
"You grant the license to display uploaded content on this forum and only this forum. The pro forum claims no ownership or rights to sell or sub-license content to third parties."

Anyone have any thoughts?

Chris,

I don't see a problem at this point but it could become one in the future. My concern is if they are able to "lift" ideas from the group to show in other outlets. But, I believe Anna Nicole married for love too.
